On June 22, 2009, President Obama signed the Family Smoking Prevention and Tobacco Control Act granting the U.S. Food and Drug Administration (“FDA”) broad authority to regulate cigarettes and tobacco. The FDA now controls what goes into cigarettes, how they are packaged and labeled and how they are marketed and sold, among other powers.
